AVID Community Terms of Use
The following terms (Terms of Use) lay out the rules for accessing and using the AVID Community (Ambient Voice Innovation and Development online community) and all the functionalities provided (the Service) as described below. These Terms of Use govern each component of the Service and others that may be introduced in future. By joining the AVID community and using the Service, you confirm that you accept these Terms of Use and that you agree to comply with them. If you do not agree to the Terms of Use, you must not use the Service. These terms may be amended from time to time. Every time you wish to access or use the Service, please check the Terms of use to ensure you understand the terms that apply at that time. ## Description of the Service The AVID community exists to support open, informed, and collaborative exploration of ambient voice technology in healthcare. It is a space where you can share experiences, ideas, and questions, and work together to address key issues, for example use cases, piloting, and best practice in implementation and evaluation. The AVID Community is managed by THIS Institute, a research institute which is part of the University of Cambridge. It uses HumHub Community Edition open-source code and is hosted by Thiscovery, which is run by THIS Labs Ltd. The Service enables members to join and participate in the AVID community. When you join a Space on the AVID community, you will be able to participate in relevant activities, which may include the ability to: - Post messages for other community members to see and respond to - Access curated information, including links to relevant topics - See files and links that may be useful to you - Collaborate on solution-building - Provide feedback on important topics or developments - See invitations to events - Help keep the AVID community safe by reporting inappropriate content - Receive tailored notifications on updates on the AVID community ## Access to the Avid community: membership The AVID Community is an online community of members, currently open to those, including health and social care staff, policy-makers, evaluator and academic researchers, and staff of think tanks who are professionally engaged or interested in the development, implementation, or evaluation of Ambient Voice Technology (AVT) in healthcare. The Service is made available free of charge and access to the Service is on the basis of the creation of a member account. After registering your email by clicking the ‘Sign Up’ button you will receive an email containing a link to complete the registration form. This requires you to enter your information through the online registration form (including your Full name, Professional role/title, Organisation/affiliation, Work email, Country). Membership of the AVID community is not available to people under 18 years of age. - You agree to provide only accurate and complete information when creating or updating your account information. - You must keep your account details safe. If you choose, or you are provided with, a username, password or any other piece of information as part of the Service security procedures, you must treat such information as confidential. You must not disclose it to any third party. Credentials are for one user only and cannot be shared. - Anonymous accounts are not permitted. - The community administration team have the right to disable any username or password, whether chosen by you or allocated by the team, at any time, without prior notice. If at any time you become aware that an unauthorised attempt to access the service using your credential has made, you must inform Community Administrator by email [avtcommunity@thisinstitute.cam.ac.uk](mailto:avtcommunity@thisinstitute.cam.ac.uk) and Thiscovery by emailing [security@thiscovery.org](mailto:security@thiscovery.org) There is no guarantee that the Service, or any content on it, will always be available or uninterrupted. Availability of all or any part of the Service may be suspended, withdrawn, or restricted for business and operational reasons. ## Code of conduct We ask you to commit to use the Service in accordance with the Code of Conduct specific to each community space you join and subsequently when Code of Conduct has been updated. You will need to accept the Code of Conduct in order to access the community space. If you do not agree to the Code of Conduct you will not be able to join as a member of the community space. All members of the community are expected to treat each other with respect and courtesy. Moderation will be used to ensure the comfort and safety of participants and to ensure that the community is compliant with relevant legislation. The Online Safety Act covers a broad range of illegal content that must not be posted, including but not limited to terrorism, harassment, stalking, threats and abuse, child sexual exploitation and abuse, animal cruelty, and so on. Other content not permitted on our community includes any information that might identify a patient or member of the public or information that is defamatory or abusive, contains threats or spam, or is commercial or advertising in character. You may only upload content that you own. Material that infringes copyright or other intellectual property rights will be removed. ### Reporting and moderation The community administration team has the right to moderate content and to remove any content it deems to be illegal, harmful, or inappropriate and/or suspend or terminate the account of the member who originally posted the reported content. If you see inappropriate content, please use the “Report” button on the drop down of each post. You may not use them without permission. The University of Cambridge, through THIS Institute, is the owner or the licensee of the intellectual property rights in the AVID Community and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. Material prepared for the primary purpose of providing information about The AVID Community, THIS Institute or the University of Cambridge has been placed on the site by the THIS Institute (‘University Material'). Subject to statutory allowances, extracts of material from the site may be accessed, downloaded and printed for your personal and non-commercial use and you may draw the attention of others within your organisation to material posted on the site. The University's status and that of any identified contributors as the authors of material on the site must always be acknowledged. You may not modify the paper or digital copies of any material printed off or downloaded in any way and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. You must not use any part of the material on the site for direct or indirect commercial purposes or advantage without obtaining a licence to do so from the University or its licensors. By seeking a licence from the University to reproduce University Material for commercial or other uses beyond that permitted above, the University can ensure that individuals and organisations have access to the most up-to-date material. If you print, copy or download any part of the site in breach of these terms of use, your right to use the site will cease immediately and you must at the option of the University return or destroy any copies of the material you have made. Nothing contained in the site shall be taken, construed or considered as a grant of licence or right to use the trademarks of the University of Cambridge or that of any third party displayed on the site without the prior written permission of the respective owner/s. In submitting a contribution to the AVID Community: 1. You grant to the University a non-exclusive, world-wide, royalty-free licence to copy, reproduce, broadcast, transmit, display and perform by all means all or part of your contribution on the AVID Community for the entire period of copyright in your contribution and all renewals, extensions or revivals thereof. THIS Institute may use material posted on the community (such as, but not limited to, posts, comments, responses to polls, wikis etc) for purposes of evaluation, research, or developing training or other resources to support innovation and improvement in healthcare. THIS Institute will not use your name when they do this – all material will be fully anonymised; and 2. You warrant that: - Your contribution is your own original work or you have a licence from the author/s or copyright owner/s of the work granting the University use of the work on the terms of the foregoing licence granted by you; and - You will comply with the Code of Conduct and - Your contribution does not infringe the copyright or other intellectual property rights of any person or organisation, which includes your having obtained sufficient rights (by written permission/licence or consents as appropriate) for the University to exercise the foregoing licence granted by you- - from rights holders of third party copyright materials that you may have included in your contribution in whole or in part, e.g. others' literary works, photographs or other artistic works, dramatic works, musical works, sound recordings, films or broadcasts, and/or that others' materials are used in your contribution under statutory (legislative) exemption such as fair dealing for the purposes of criticism or review, and - from all identifiable persons in any images or video/film and/or sound recordings that you may have included in your contribution (including parental/legal guardian consent for those under 16 and for those who are vulnerable adults). ## Suspension or termination of membership THIS Institute and Thiscovery retains the right to suspend your access to the Service in order to make any investigation that might be necessary following a content report or in case of presumed breach of Terms of Use which may be remediated. A member whose account is suspended will be informed by THIS Institute or Thiscovery of such a decision by email. The member has the opportunity to send an email to obtain additional information on the reasons for the suspension as well as to provide explanations and/or any element in order to demonstrate that the breach has been remediated. If the violation of Terms of Use is not remedied within one (1) month from suspension notification, THIS Institute and Thiscovery reserve the right to terminate the member’s account and right to use the Service, in addition to any other rights or remedies available. Reasons for suspension or termination could include, but are not limited to: - Breaching the Terms of Use or the AVID community Code of conduct - Attempting to gain unauthorised access to the website or its systems - Providing false or misleading identity information - Extended periods of account inactivity - Introduction of malware, viruses, or malicious code - Attempts to interfere with platform functionality or other users' access - Scraping, data mining, or automated access without permission - Reverse engineering or attempts to discover source code without consent from Thiscovery ## Limitation of warranty and liability; indemnification THIS Institute are not responsible for the compatibility of your device nor any ability to connect due to any technical problem related to the Internet network or a failure of your computer facilities or equipment. THIS Institute shall not be responsible for your system, nor any problems arising from or related to your system or caused by the Internet. You are responsible for the security of your system and the security of its access to and connection with the Service. Any document, information, data, or elements available via the Service, including member content (“Information”) is provided without any guarantees, notably that the Information is comprehensive or accurate. Material is provided on an 'AS IS' and 'AS AVAILABLE' basis. To the extent permitted by law, THIS Institute exclude any representations or any warranties (whether express or implied by law), including the implied warranties of satisfactory quality, fitness of a particular purpose, non-infringement, compatibility, security and accuracy. Unless stated otherwise, the site may contain advice, opinions, statements or other information by various authors or organisations. Reliance upon any such advice, opinion, statement or other information is at your risk and to the extent permitted by law THIS Institute disclaim all liability and responsibility arising from any reliance placed on such information by any user of the site or by anyone who may be informed of such information. You are solely responsible for all Member Content that you post. You assume all risks relating to its use by others and others’ reliance on its accuracy. You acknowledge that, following the publication of any content, such information will become accessible to all the members in the community. Thiscovery and THIS Institute will have no responsibility or liability in connection with the member Content. Thiscovery and THIS Institute expressly excludes any liability for events of any kind that may occur during any meeting organised between members through the use of the Service. ##### Hypertext links The community may provide links to websites operated by third parties or other internet sources/networks, as well as data/information coming from third-party servers. Thiscovery and THIS Institute do not endorse or accept responsibility for the content or the use of third-party websites and cannot be held liable for any loss or damage following or in relation with use or the fact of having trusted the content/data/results available on such third-party servers, external sources or internet sites. Links do not imply that the AVID community is affiliated or associated with any linked site. ## Leaving the community **If you choose to leave the community** you can delete your account in your profile settings. Some of your contributions may remain visible in discussions to preserve context and continuity.
